Terms and Conditions for Bring It

1. Acceptance of Terms:

 

By downloading, accessing, or using the Bring It mobile application or website (collectively, the “Platform”), you agree to be bound by these Terms and Conditions (“Terms”).  If you do not agree, you must not use the Platform.

 

2. Definitions:

 

“Company” refers to Bring It, its subsidiaries, affiliates, and authorized representatives.  “User” or “You” means any individual or entity accessing or using the Platform.  “Driver” refers to independent contractors providing delivery services through the Platform.  “Services” refers to delivery, pickup, and logistics services offered via the Platform.

 

3. Eligibility:

 

You must be at least 18 years old and capable of entering into legally binding agreements to use the Platform.  By using the Platform, you represent and warrant that you meet these requirements.

 

4. Account Registration:

 

To access Services, you must create an account, provide accurate information, and maintain the confidentiality of your login credentials.  You are responsible for all activities under your account.

 

5. Use of the Platform:

 

You agree to:  Use the Platform solely for lawful purposes.  Not engage in fraudulent, harmful, or disruptive activities.  Comply with all applicable laws and regulations.  The Company reserves the right to suspend or terminate your account for violations of these Terms.

 

6. Delivery Services:

 

Bring It provides a platform for connecting Users with Drivers. Bring It is not a carrier and does not own or operate any delivery vehicles.  Drivers are independent contractors, not employees or agents of the Company.

          6.1 Delivery Windows and Limitations:  Delivery times are estimates and not guaranteed.  Company is not liable for delays caused by traffic, weather, or unforeseen circumstances.  Certain items (e.g., hazardous materials, illegal goods) are prohibited.  You agree not to request delivery of such items.

          6.2 Proof of Delivery:  Deliveries may require a signature, photo confirmation, or other verification methods as determined by Bring It.

 

7. Payment and Fees:

 

Users agree to pay all applicable charges, fees, and taxes related to Services.  Payment is processed through the Platform using authorized payment methods.  All charges are non-refundable unless required by law.

 

8. User Responsibilities:

 

You agree to:  Provide accurate pickup and delivery information.  Ensure items are properly packaged and labeled.  Not include prohibited or unlawful goods.  You are responsible for any damage or loss caused by failure to comply with these obligations.

 

9. Intellectual Property:

 

All content, trademarks, and intellectual property on the Platform belong to Bring It or its licensors. You may not copy, reproduce, distribute, or create derivative works without written consent.

 

10. Disclaimers and Limitation of Liability:

 

Bring It provides the Platform “AS IS” without warranties of any kind.The Company is not responsible for the acts or omissions of Drivers.To the fullest extent permitted by law, the Company disclaims liability for any indirect, incidental, or consequential damages.

 

11. Indemnification:

 

You agree to indemnify and hold harmless Bring It, its affiliates, and partners from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

 

12. Termination:

 

The Company may suspend or terminate your account at any time for any reason, including violation of these Terms, fraudulent activity, or misuse of the Platform.

 

13. Dispute Resolution:

 

Any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA) in California, unless prohibited by law.

 

14. Governing LawThese Terms shall be governed by and construed under the laws of the State of California, without regard to its conflict of law provisions.

 

15. Changes to TermsBring It may modify these Terms at any time.

Updated Terms will be posted on the Platform, and continued use constitutes acceptance.
